These Terms of Service ("Terms") govern your access to and use of the Taqseem Zakat management platform ("Service"), operated by Taqseem ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

  • "Organization" refers to the Islamic center, mosque, or non-profit entity that has registered for a Taqseem account.
  • "Administrator" refers to the person(s) designated by the Organization to manage the Taqseem account, including user roles and configurations.
  • "Staff User" refers to any individual granted access to the platform by an Administrator.
  • "Applicant" refers to any individual who submits a Zakat application through a public form hosted by the Service.
  • "Platform" refers to the Taqseem web application, APIs, and related services.

2. Eligibility

The Service is available to registered non-profit and religious organizations. You must be at least 18 years of age and authorized to act on behalf of your Organization to create or administer an account. Applicants submitting Zakat applications must be of legal age or have a guardian submit on their behalf.

3. Account Responsibilities

  • Administrators are responsible for managing Staff User accounts, roles, and permissions within their Organization.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must notify us immediately if you suspect unauthorized access to your account.
  • You agree not to share your credentials or grant access to unauthorized individuals.

4. Acceptable Use

You agree to use the Service only for its intended purpose: managing Zakat and charitable assistance applications within your Organization. You may not:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorized access to the platform, other accounts, or our infrastructure.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use automated tools (bots, scrapers) to access the Service without our written consent.
  • Upload malicious content, malware, or other harmful material.
  • Misrepresent your identity or your Organization's identity.

5. Data Ownership

Your data belongs to your Organization. All applicant records, case data, documents, and configurations entered into the platform remain the intellectual property of your Organization. Taqseem does not claim ownership of any data you submit.

We retain the right to use anonymized, aggregated data (with no personally identifiable information) for the purpose of improving the platform and generating usage statistics.

6. Data Processing

By using the Service, you authorize Taqseem to process data on behalf of your Organization as necessary to provide the Service. This includes storing, transmitting, and displaying applicant information in accordance with our Privacy Policy.

7. Service Availability

  • We strive to maintain high availability of the platform but do not guarantee uninterrupted access.
  • We may perform scheduled maintenance with advance notice when possible.
  • We are not liable for downtime caused by factors beyond our control, including internet outages, third-party service failures, or force majeure events.

8. Fees and Payment

Pricing for the Service is determined on a per-Organization basis. Free tiers, trials, or promotional offers may be available at our discretion and are subject to change. If applicable, payment terms will be outlined in a separate agreement between Taqseem and your Organization.

9. Termination

  • Either party may terminate the Service agreement with 30 days written notice.
  • We reserve the right to suspend or terminate access immediately if these Terms are violated.
  • Upon termination, we will provide a reasonable period (minimum 30 days) for the Organization to export its data before deletion.
  • Provisions that by their nature should survive termination (including data ownership, limitation of liability, and indemnification) will survive.

10. Limitation of Liability

To the maximum extent permitted by law, Taqseem shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or goodwill. Our total liability for any claim arising under these Terms shall not exceed the amount paid by your Organization to Taqseem in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Taqseem, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your Organization's handling of applicant data.

12. Modifications to the Service

We may update, modify, or discontinue features of the Service at any time. We will provide reasonable notice for material changes that affect your use of the platform. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Modifications to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify account Administrators by email. Your continued use of the Service after revisions take effect constitutes acceptance.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through good-faith negotiation before pursuing formal legal proceedings.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and any separate service agreements, constitute the entire agreement between you and Taqseem regarding the Service.
